A defendant shall be punished by imprisonment for six months.
Reasons
Punishment of the crime
1. On April 25, 2015, at around 03:00 on April 25, 2015, the Defendant: (a) discovered the victim D being under influence of alcohol in the south-gu India, Nam-gu; (b) cut off the victim’s 70,000 won in cash; (c) one sheet of Hyundai Credit Card; (d) one sheet of Hyundai Credit Card; and (e) one copy of the MCM wall with one resident registration certificate; and (d) one MacM 30,000 won in total with 950,000 won in market value.
2. On April 25, 2015, the Defendant violated the Specialized Credit Financial Business Act: (a) paid accommodation charges at the Felel located in North Korea-Gu E at port on April 25, 2015; and (b) made the said employee, by presenting one copy of the Hyundai Card in the name of D, which was stolen as if the Defendant was said D, prepare and deliver a copy of the Credit Card sales slip of KRW 50,000 to the said employee; (c) signed and issued the member signature in the member signature column; and (d) obtained pecuniary benefits equivalent to the said amount by deceiving the said employee to be exempted from paying KRW 50,000 by deceiving the said employee.
In addition, from the above date to April 27, 2015, the Defendant used a stolen credit card on a total of 20 occasions, such as 1 to 9, and 11 to 21, as indicated in the List of Offenses (1). At the same time, the Defendant was exempted from paying a total of 482,406 won, and at the same time acquired a pecuniary benefit equivalent to the same amount. At the same time, the Defendant used a stolen credit card on one occasion as indicated in the List of Offenses (10), and obtained a pecuniary benefit of KRW 40,000 at the same time as indicated in the List of Offenses. However, the Defendant was refused to grant the credit card and failed to achieve its intent.
3. On May 7, 2015, the Defendant: (a) committed larceny and attempted larceny on May 7, 2015; (b) around 224-gil-ro 11-1 road in Gwangju-dong-gu, Gwangju-gu, Gwangju-gu, about May 7, 2015, with a view to raising an entertainment expense, etc. on the 224-gil-ro 11-1 road; (c) had a new wall-hour house downloads the alley path; and (d) had a H franchise owned by the Victim G.
