Defendant shall be punished by a fine of KRW 1,500,000.
If the defendant does not pay the above fine, the amount of KRW 100,000 shall be paid.
Reasons
Punishment of the crime
1. At around 00:30 on June 22, 2014, the Defendant: (a) obtained 50,000 won in cash owned by the victim E; (b) obtained 180,000 won in cash owned by the victim E; and (c) obtained 180,000 won in the market price of the IBK Enterprise Bank Card; and (d) embezzled the property that he/she had on his/her own idea to have, without following necessary procedures, he/she embezzled the property that he/she left the possession of the victim.
2. Violation of the Specialized Credit Finance Act;
A. On June 22, 2014, the Defendant purchased two KB national cards (H) in the name of E acquired, such as the preceding paragraph, at G convenience stores located in GE on June 10:41, 2014, and had the said convenience store business owner I present the said credit card and then used the credit card lost by making a false signature.
B. On June 22, 2014, around 10:47, the Defendant paid oil equivalent to KRW 50,000 on his/her own vehicle, in the L station operated by KJ at a S station located in the Si-si. On June 22, 2014, the Defendant provided a false signature on the sales slip and used the lost credit card after having a gas station N enter into the sales slip under the E’s name.
C. On June 22, 2014, around 10:56, the Defendant: (a) purchased goods, such as the Hanbox, etc. equivalent to the market price of KRW 23,660, from the Qma, which was located in the PO in a macro-si O; (b) had R, presenting the above credit card in the name of E, and used the credit card lost by falsely signing and signing on the sales slip.
3. Fraud;
A. The Defendant purchased 1,980 won from the victim I at the date, time, and place specified in paragraph 2(a) and carried out as if the Defendant was a legitimate user of the KB national card owned by E. However, the Defendant was merely the acquisitor of the KB national card lost by E, and there was no legitimate authority to use the said credit card.
