1. The part against the defendant in the judgment of the court of first instance shall be revoked, and the plaintiff's claim corresponding to the revoked part shall be dismissed.

(1) The part of the insurance money paid to C (insured) (a) is entitled to indemnity, and the Plaintiff paid insurance money to C (insured)’s bereaved family members according to the “other automobile driving security agreement” concluded with C. According to the above terms and conditions, “if the insured has suffered damage as a result of the personal accident or physical accident that occurred while driving another motor vehicle, or if the insured has suffered an injury, it shall be deemed as an insured motor vehicle under the ordinary terms and conditions as stipulated in the automobile accident and shall be compensated as an insured motor vehicle under the ordinary terms and conditions.” Accordingly, the Plaintiff deemed the instant accident to be an insured accident (accident) stipulated in the automobile insurance clause, and paid KRW 100 million death insurance money under the special terms and conditions of the automobile accident to C’s bereaved family members as insured motor vehicle. 2) The automobile accident insurance incurred from the insured motor vehicle accident that occurred during its possession and management of the insured motor vehicle in accordance with the insured motor vehicle insurance policy.
