The defendant shall be innocent.

1. On March 28, 2014, the Defendant: (a) was a substitute driver on behalf of the customer C on behalf of the customer C on March 23:45, 2014; (b) called C and C on the road near the 1st-dong office of the 1st-dong office in Taeju-si, and called C and C on the behalf of the principal driver; and (c) reported to F in the circumstances where the principal police station called C upon receipt of the report, “A request to regulate that there is a person who intends to drive on a drinking”; and (d) changed punishment to F in the principal police station of the principal police station who called C upon receipt of the report to the effect that “C was able to drive on behalf of the principal, at around 0:10 on March 29, 2014, he voluntarily moved to the H district located in G, and submitted the borrower’s conscience to the effect that “I would have avoided the vehicle from drinking.”

However, the fact that C was driven by the defendant at the end of the fee, and C was driven by the driver's seat at the time and changed the terms of the vehicle to the parking condition, and there was no fact of driving the vehicle.

As a result, the defendant was arrested for the purpose of having C receive criminal punishment.

2. At the time of the Defendant’s assertion, C had been driving a motor vehicle with Dials (hereinafter “instant motor vehicle”) with Dials while drinking, so the Defendant’s report to that effect is not false.

3. Determination

A. As evidence directly corresponding to the facts charged in the instant case, there are ① some statements from the police and the prosecution of the Defendant, ② the police and the prosecution of C, and statements from this court.

In other words, on March 28, 2014, the Defendant appeared to the effect that C was a drunk driver on March 28, 2014. On March 29, 2014, on March 29, 2014, C was a witness of C's drinking driving at the H district of the original State Police Station around 00:10.
