1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. Basic facts

A. (1) around October 1994, Nonparty C (the husband of the Defendant) constructed a 198 square meters of block structure, wooden jun-si, Namyang-si, located within a development-restricted zone.

Dor C was engaged in livestock breeding business by extending the 907.8m2, 907 m2 without permission from the competent authority.

Consolidatedly, the defendant succeeded to the livestock breeding business around March 2016 after C died of around 2015 and was granted permission.

B. On December 26, 2016, the Plaintiff leased the said livestock shed amounting to KRW 10 million for the Defendant, KRW 10 million for the rent, KRW 10 million per annum, and the period from March 30, 2017 to March 30, 2020 for the rent.

At the time, the plaintiff and the defendant were subject to special agreement, and the fine imposed due to the illegal use for other purposes is borne by the plaintiff, the retirement after maturity shall be restored to its original state without any condition, and the building, including the building not indicated on the register, was used by the plaintiff

C. The Plaintiff remodeled part of a stable into residential facilities (two kitchens, one kitchens). D.

On September 14, 2017, the Plaintiff slaughtered and shipped 11 heads of meat, respectively, on March 12, 2018, and April 2, 2018. Meanwhile, on April 20, 2018, the Plaintiff abolished 1 head of meat (23 months) on April 20, 2018.
