All prosecutions against the Defendants are dismissed.

1. The summary of the facts charged is as follows: (a) Defendant A is responsible for the chairperson, Defendant B, and C of the “H Village Countermeasures Committee” comprised of residents living in the above H Village with respect to the construction of a golf course (G) executed by the Victim E (RepresentativeF) at the Gyeong-gun, Southern-gun, Chungcheongnam-do.

1. The Defendants’ co-principal

가. 피고인들은 2011. 여름경 경남 남해군 H마을 입구 도로상에서, 피해자 I이 위 골프장 건설공사와 관련 인근주민들과 작성한 협약서를 제대로 이행하지 않은 채로 공사를 강행한다는 이유로 ‘힘으로 빽으로 밀어부쳐 힘없는 주민 기만하는 I 본부장은 즉각 물러나고 골프장 공사 중단하라’는 글이 기재된 현수막 1개를 제작 게시함으로써 공연히 사실을 적시하여 피해자 I의 명예를 훼손하였다.

B. On February 2013, the Defendants: (a) on the road at the entrance of the H village in the Southernnam-gun, Gyeongnam-gun; (b) on the ground that the victim I paid an amount equivalent to the amount actually paid to the victim I on the spot of dialogueing with the neighboring residents related to the said golf course construction work; and (c) on the ground that the head of the I headquarters who discovered false facts that I compensated for KRW 9 billion was a fraudulent change, thereby damaging the victim I’s reputation by openly pointing out facts.

C. On February 2013, at the entrance road of a golf course (G) construction site in the Southern-west Navy, the Defendants, on the ground that the victim E company did not properly implement the contents of the agreement on the payment of the student scholarship prepared with neighboring residents related to the said golf course construction project, the Defendants were aware of the victim E company by openly pointing out the fact by posting two banners on the ground that E company did not properly implement the contents of the agreement on the payment of the student scholarship in the agreement prepared with neighboring residents related to the said golf course construction project. [State] E, a student scholarship in the agreement, [State], “E,” and “E, a company with which the fraud is converted,” respectively.
