1. The Defendant’s possession of KRW 992,250 and KRW 38 from September 23, 2020 to the date of termination of possession by the Defendant.
Reasons
1. The following facts are either in dispute between the parties or in full view of Gap evidence 1, evidence 1, evidence 2, evidence 2-1, evidence 3, evidence 6-1, 2, evidence 9, 11, and 12, evidence 13-1, 2, and 3 of evidence 13-1, and evidence 13-3, the whole purport of the pleadings can be acknowledged:
The registration of ownership transfer was completed on October 5, 1972 with respect to Kimcheon-si Kim 38 (hereinafter “instant land”) under the name of the Defendant on the ground of sale and purchase as of October 29, 1985. However, on the ground of the contract concluded as of April 27, 2016, the establishment registration of a mortgage (hereinafter “mortgage-mortgage-mortgage-mortgage-mortgage-mortgage-mortgage-mortgage-mortgage-mortgage-mortgage-mortgage-mortgage-mortgage-mortgage-mortgage-mortgage-mortgage-mortgage-mortgage-mortgage-mortgage-mortgage-mortgage-mortgage-mortgage-mortgage-mortgage-mortgage-mortgage-mortgage-mortgage-mortgage-mortgage-mortgage-mortgage-mortgage-mortgage-mortgage-mortgage-mortgage-mortgage-mortgage-mortgage-mortgage-mortgage-mortgage-
나. 2016. 7. 19. 근저당권자인 D의 신청으로 이 사건 토지에 관하여 대구지방법원 김천지원 E로 임의경매개시결정이 있었는데, 현황조사결과 이 사건 토지 지상에 제시외 건물로 별지 도면 표시 경량철골조 아스팔트슁글지붕 단층(주택) 약 52㎡(㉠부분), 판넬조 판넬지붕 단층(창고) 약 8㎡(㉡부분), 판넬조 판넬지붕 단층(보일러실) 약 1.6㎡(㉢부분), 판넬조 판넬지붕 단층(화장실) 약 1㎡(㉣부분)의 미등기 건물(이하 ‘이 사건 각 건물’이라 한다)이 있었던바, 원고는 위 경매절차에서 이 사건 토지를 매수하여 '2017. 3. 23.자 임의경매로 인한 매각'을 원인으로 하여 2017. 3. 27. 원고 명의로 이 사건 토지에 관하여 소유권이전등기를 마쳤다.
C. Meanwhile, on the ground of the instant land, there was a soil brick structure with the total floor area of 40.32 square meters owned by the Defendant, but around September 2003, it was destroyed by typhoons, and thus, it was newly constructed each of the instant buildings around that time. On May 6, 2020, the said soil brick structure was deleted on the building ledger.
The defendant has completed resident registration with the lot number of the land in this case as the domicile.
