1. The Defendants jointly share KRW 41,466,156 with respect to the Plaintiff, and the period from November 30, 2013 to December 23, 2015.

1. Grounds for occurrence of liability for damages and liability;

가. 원고의 남편인 망 B(이하 망인이라 한다)은 2013. 11. 30. 00:32경 자신의 소유인 C 개인택시(이하 원고 차량이라 한다)를 운전하여 서울 마포구 상암동 가양대교 남단에서 북단 방향으로 편도 3차로 중 1차로로 주행하다가, 전방에 차량 고장으로 정지해 있던 D 화물자동차(이하 피고 1 차량이라 한다)의 우측 뒷부분을 원고 차량 좌측 앞부분으로 충격한 후 2차로로 튕겨졌고, 때마침 2차로로 진행하던 E 택시(이하 피고 2 차량이라 한다)의 앞 범퍼 부분에 원고 차량 운전석 측면 부위를 들이 받혀 중증뇌손상을 입고 사망하였다

The Plaintiff, as his wife, succeeded to the claim for damages due to the instant accident. The Defendant Dongbu Fire Insurance Co., Ltd. (hereinafter the Defendant Dongbu Fire) is an insurer who entered into a comprehensive automobile insurance contract for Defendant 1’s vehicle, and the Defendant Korea Passenger Transport Business Association (hereinafter the Defendant Federation) is a mutual aid business entity who entered into a mutual aid agreement for Defendant 2’s vehicle.

C. The instant accident based on liability is attributable to the operation of Defendant 1 and 2 vehicles, barring any special circumstance, the Defendants are jointly and severally liable to compensate the Plaintiff for damages arising from the instant accident.

2. Determination as to the defendants' exemption from liability and limitation of liability

A. (1) The instant accident concerning Defendant East Fire was caused by the violation of the duty of front-time display of the Plaintiff’s driver’s vehicle, and Defendant 1’s driver is driving on the vehicle with an emergency, etc. immediately after the vehicle stops due to a malfunction while driving along one lane.
