A defendant shall be punished by imprisonment with prison labor for up to eight months and a fine of up to seven million won.

Punishment of the crime

The Defendant is a person who manufactures and sells red paper powder with the trade name of “C” in Heak-gu, Chungcheongnam-gu.

A person who produces, processes, ships, or sells agricultural and fishery products or the processed products thereof prescribed by Presidential Decree, such as molds and powder of 2019dan249, shall indicate the country of origin on agricultural and fishery products, processed agricultural and fishery products, or raw materials of processed agricultural and fishery products, and shall not indicate the country of origin fraudulently.

Nevertheless, from October 2018 to March 29, 2019, the Defendant divided and combined 4,320 km in China (an amount equivalent to KRW 19,90,60) from around October 2018, and 445 km in Korea (an amount equivalent to KRW 7,017,00), and 750 km in Korea (an amount equivalent to KRW 1,962 g, 38,537,500), 50% in Korea, 50% in China, 50% in China (an amount equivalent to KRW 983 g, 8,842,500), 30% in Korea, 70% in Korea (an amount equivalent to KRW 2,570 g, 252,505), and sold 50 g,515 g,51,505 g in Korea, respectively.

Accordingly, the Defendant made a false indication of the origin of red paper powder, a processed agricultural product.

A food manufacturing and processing business operator of 2020 group 4 shall prepare documents disturbing the official records of production and work and documents pertaining to the receipt of raw materials for storage, delivery, and use of raw materials, and shall not prepare false documents, and the relevant documents shall be kept for three years from the date of the last entry.

Nevertheless, while the Defendant manufactured and sold products, such as “chilling powder”, “chilling powder”, and “chilling” at the same place from October 17, 2018 to September 25, 2019, the Defendant did not prepare documents related to the production and work records of the said products and documents related to raw materials storage, delivery, and use.
