Punishment of the crime

(a) No person who is aware that he/she is to be used for a crime or to be used for a crime shall lend, store, deliver or distribute access media;

그럼에도 불구하고, 피고인은 2016. 9. 초순경 중 국내 보이스 피 싱 범죄 조직원인 조선족 E( 위 쳇 메신저 대화명 ‘F’ )로부터 “ 네 가 출소한 지 얼마 안 되었으니 다른 사람을 시켜 일을 시작해 보자. 그리고 돈을 인출해서 보내주면 인출금액의 8%를 주겠다” 는 제안을 받고, 이 정을 모르는 피고인의 형인 G를 통하여 체크카드가 들어 있는 택배 상자를 성명 불 상의 보이스 피 싱 조직원에게 전달하기로 마음먹은 다음, 위 G에게 “ 택배를 보내는 일이 있으니 받아서 배달만 해 주면 일당으로 10만 원을 주겠다” 고 말하였다.

이 제안을 승낙한 위 G는 2016. 9. 29. 경 위 E로부터 위 쳇 메신저를 통하여 택배를 받으라는 말을 듣고, 같은 날 서울 성북구 북악산로 746, 정 릉 우방아파트 1 단지 앞 노상에서 성명 불상의 퀵 서비스기사로부터 B 명의의 KEB 하나 체크카드 (H) 1개, IBK 기업은행 체크카드 (I) 1개, NH 농협은행 체크카드 (J) 1개가 들어 있는 택배상자를 전달 받아 이를 보관하였다.

Accordingly, the defendant, in collusion with E, had G keep three physical cards, which are access media, and stored access media for the purpose of using them for crime.

B. Except as otherwise expressly provided for in other laws, Defendant B may not transfer or take over any access medium, or lend or lease any access medium to or from another, require, accept, or promise to demand, deliver, distribute or pay any access medium.

Nevertheless, on September 29, 2016, the Defendant is in front of the “Transport Training Institute” located in Gyeyang-gu Incheon Gyeyang-gu, Incheon.
