Punishment of the crime

【Defendant A’s past record of crime committed on March 18, 2016, was sentenced to imprisonment with prison labor for a crime of fraud and a crime of violating the Electronic Financial Transactions Act at the District Court on March 18, 2016, and the final sentence was changed to one year after consolidation with other cases at the appellate court, but the main text is subject to the written indictment.

On January 13, 2017, the sentence was completely executed in the due Eup/Myeon prison.

(a) No person who violates the Electronic Financial Transactions Act shall borrow or lend any access medium, or store, deliver or distribute such medium with the knowledge that such medium is to be used for a crime or to be used for an offense, unless otherwise specifically provided for in any other Act, in using or managing any access medium;

그럼에도 피고인은 2017. 3. 17. 경 인터넷 검색을 통해 알게 된 성명 불 상의 보이스 피 싱 조직원( 위 챗 닉네임 ‘D’ )으로부터 보이스 피 싱 범행에 이용될 카드를 배달해 주면 일당 30만 원을 주겠다는 제안을 받고 이에 응하여 배달을 하던 중 2017. 3. 20. 경 위 조직원에게 인출을 할 수 있도록 해 달라고 부탁하여 인출 책으로 일하게 되었다.

(3) On March 21, 2017, the Defendant is the Gangseo-gu Seoul Metropolitan Government Croro, Gangseo-gu, around 10:45.
