Reasons
Punishment of the crime
In around 2012, the Defendant purchased scrap metal from the victim G who operated a steel-frame producer with the trade name of “E” in the name of “E” in the Jincheon-gun, Jincheon-gun, the Defendant came to know of the victim. On March 2014, the victim and the victim agreed to establish a factory by investing funds, etc., and the Defendant agreed to establish a steel-frame producer in a manner in which the business is in charge, and accordingly, the victim established a steel-frame producer in the trade name of “H” and purchased the I land in the name of H in order to establish a factory.
1. A embezzlement: (a) around November 2013, the Defendant came into contact with F’s business due to the failure of the original Cheongcheon-gunJ; (b) accepted the F’s request to dispose of facilities and materials used in F at the highest price on the water surface, etc.; and (c) disposed of at least KRW 102,362,620 at the market price of CO2, such as CO2 adjoining machines, etc.; (d) KRW 50,00,000 at the market price of 53 kinds of tools, equipment, and steel plates, etc., such as the list of crimes in the separate sheet; and (e) stored them on the water surface of the “E” located in Jincheon-gun, Jincheon-gun, 201, around February 2, 2014; and (e) disposed of at least KRW 14 million on the water surface of the said 53 kinds of tools, equipment and facilities on the water surface of the Defendant.
On February 2, 2014, the Defendant, while keeping for the victim an amount equivalent to KRW 42 million in total of the proceeds from disposing of tools, facilities, and materials owned by the victim, embezzled the said money by arbitrarily consuming it for the purpose of living expenses, etc.
2. Fraud;
A. On July 24, 2014, the Defendant: “Around July 24, 2014, the victim is a person who is well aware of the bank side in Seoul, and, if M is paid money, the Defendant attempted to obtain a loan from a bank located in Seoul to obtain necessary funds for the construction of a factory from the bank.”
