1. The plaintiff's appeal is dismissed.
2. The costs of appeal shall be borne by the Plaintiff.
The purport of the claim and appeal is the purport of the appeal.
Reasons
1. The court's explanation concerning this case is based on the reasoning of the judgment of the court of first instance.
(2) In addition to the use of paragraph (4) and below (3) as follows, it is identical to each corresponding part of the reasoning of the first instance judgment, and thus, it shall be quoted in accordance with Article 8(2) of the Administrative Litigation Act and the main sentence of Article 420 of the Civil Procedure Act.
2. The phrase “matters in the process of audit, supervision, inspection, test, regulation, tendering contract, technology development, personnel management, decision-making process, or internal review process” under Article 9(1)5 of the Information Disclosure Act as to whether the instant information constitutes information subject to non-disclosure is deemed to be an example of the information subject to non-disclosure. As such, where the meeting-related data provided in the decision-making process or the minutes on which the decision-making process has been recorded are determined or executed, the matters in the decision-making process cannot be said to be the said matters themselves, but may be included as matters corresponding to the matters in the decision-making process, which
(2) Article 9(1)6 of the Information Disclosure Act provides that “Any personal information, such as the name and resident registration number, etc., included in the relevant information, which is deemed likely to infringe on the privacy or the freedom of privacy if disclosed,” is one of the information subject to non-disclosure, and Article 9(1)6 of the same Act provides that “information prepared or acquired by a public institution, which is deemed necessary for the public interest or the relief of an individual’s rights, shall be excluded.” As an exceptional requirement for disclosure of personal information, whether the disclosure of personal information constitutes “information deemed necessary for the relief of an individual’s rights” is the interest and disclosure of personal information, etc. protected by non-disclosure.
