A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

The Defendant is the head of the “D Child Care Center,” a private individual nursery in Kimhae-si, who is operated by the Defendant.

1. Fraudulent of subsidy (Fraud, violation of the Act on the Management of Subsidies, and Violation of Infant Care Act);

A. On March 2, 2012, the Defendant filed a false report on the appointment and dismissal of E at the above D Child Care Center as a monthly overtime childcare teacher at the victim Kimhae-si, a competent authority, on March 2, 2012.

However, there was no fact that E had worked in the above child care center.

피고인은 이와 같이 피해자를 기망하여 이에 속은 피해자의 보육담당 공무원으로부터 2012. 3. 25. 경 E의 보육교사 인건비 명목으로 1,265,700원( 국비 759,420원, 도비 202,512원, 시비 303,768원) 의 보조금을 D 어린이집 명의 계좌로 교부 받고, 같은 날 근무환경개선 비 명목으로 50,000원( 국비 30,000원, 도비 8,000원, 시비 12,000원), 특수 수당 명목으로 100,000원 (도 비 50,000원, 시비 50,000원), 근무 수당 명목으로 50,000원( 시비) 의 보조금을 E 명의 계좌로 각각 교부 받고, 2012. 6. 25. 경 E의 처우개선 비 명목으로 20,000원 (도 비 6,000원, 시비 14,000원) 의 보조금을 E 명의 계좌로 교부 받고, 2012. 9. 25. E의 격무 수당 명목으로 50,000원 (도 비 15,000원, 시비 35,000원) 의 보조금을 E 명의 계좌로 교부 받은 것을 비롯하여 그때부터 2013. 2. 25. 경까지 별지 범죄 일람표⑴ 내지 ⑹ 기재와 같이 부정한 방법으로 합계 18,412,050원 상당의 보조금을 교부 받아 편취함과 동시에 국고 보조금 9,799,230원을 교부 받았다.

B. On March 2, 2012, the Defendant filed a false report on the appointment and dismissal of the Defendant F, the husband of the Defendant, at the victim Kimhae-si, a competent administrative agency around March 2, 2012, as a after-school teacher.

However, the F did not have worked as a after-school teacher for a person who mainly engaged in the management of facilities such as a vehicle, business affairs, etc.

The defendant deceivings the victim and is under his control.
