가. 피고인 A 피고인과 피고인의 친구인 D은, 2017. 7. 7. 23:15 경 부천시 E 건물 1 층에서, 피해자 F(51 세), 피해자 B(49 세, 상 피고인) 의 일행인 G가 술에 취해 갑자기 피고인의 젖꼭지를 꼬집은 것이 발단이 되어 시비하던 중 화가 나, D은, 피해자들의 얼굴을 주먹으로 각 3회 씩 때리고, 정신을 잃고 바닥에 쓰러진 피해자 B의 몸에 올라 타 약 5초 간 피해자 B의 목을 조르고, 바닥에 쓰러졌다가 일어나는 피해자 F을 다시 밀어 넘어뜨린 후 피해자 F의 몸에 올라 타 주먹으로 피해자 F의 뒷통수를 4회 때렸고, 피고 인은, 주먹으로 피해자 F의 얼굴을 3회, 피해자 B의 얼굴을 1회 각 때리고, 피해자 B이 넘어지자, 발로 피해자 B의 몸통을 3회 차고, 주먹으로 피해자 B의 얼굴을 1회 때리고, 일어나려고 하는 피해자 B의 얼굴을 주먹으로 다시 1회 때렸다.
