A For each crime of occupational embezzlement, a fine of KRW 7,00,000 is imposed, and each judgment violates the Public Official Election Act.
Reasons
Punishment of the crime
Defendant A, including the relation to the Defendants, established Q Co., Ltd. on April 13, 1990, and operated the said company as a 1st shareholder, and elected at the 19th National Assembly member general election implemented on April 11, 2012. Defendant B was elected by going to the Pyeongtaek-si election district and going to the election district. Defendant B was employed as a director from March 2, 2010 through the head of division, vice head and head of division, etc. around April 1997, and Defendant C was a child of Defendant A, who was working as a person related to the election campaign of Defendant A at the time of the said election, and T was a person who was engaged in election campaign as a core witness of Defendant A at the time of the said election.
Criminal facts
1. Occupational embezzlement - Joint Crimes committed by Defendant A and B;
A. At around April 2009, U-related Defendant A instructed U to transfer a certain amount monthly amount to U who is a former SP representative V, and ordered U to register U’s “U is on the worker list” with Defendant B at the office of Pyeongtaek-si QP Co., Ltd. (hereinafter “victim” in the part related to occupational embezzlement, and “ Q” in the remaining part) and transfer KRW 2,50,000 per month to U.S.
Accordingly, the above Defendants conspired to enter U in the list of employees of the victim company around April 2009, and transferred 2,500,000 won from the victim company's Nonghyup (Y) to U on May 20, 2009, as well as from around that time to June 25, 2010.
1. The remittance of the sum of 32,500,000 won owned by the victim company to U over 13 times, such as the statement in the list of crimes.
B. On December 2011, Defendant A related to the Z construction funds needs to take up the 19th general election of the National Assembly members with Defendant B at the above office of the victim company at around December 201.
