1. The Defendant (Counterclaim Plaintiff) paid KRW 8,383,561 to the Plaintiff (Counterclaim Defendant) and its amount from February 19, 2013 to April 25, 2014.

Basic Facts

The Plaintiffs, as married couple, jointly own the land D and E (hereinafter referred to as “each land of this case”) in Nam-gu, Incheon.

On November 2, 2009, 250,000 won was extended from the Shee Credit Cooperative (hereinafter referred to as the “Shee”) on November 2, 2014, at the rate of 8% per annum, and at the rate of overdue interest rate of 17% per annum on November 2, 2014 (hereinafter referred to as the “the loan of this case”), the Plaintiffs completed the registration of creation of a mortgage over each of the lands of this case at the rate of 325,00,000 won within the scope of the maximum debt amount.

1. The Plaintiffs are the land price of KRW 288,00,000 for land price.

2. The Plaintiffs shall bear part of the cost of construction and civil engineering design, and the Defendant shall bear all the project cost related to the project of this case including taxes, public charges, and business income tax related to the project of this case, and the cost of construction design to bear KRW 4,500,000.

3. In carrying out the projects related to the project of this case, the land price shall be paid to the plaintiffs, first priority out of the sale price of each of the land in this case.

4. The sale price of bankbooks shall be set up in the name of the plaintiffs and managed by the plaintiffs.

5. 공사비 지급 ㈎ 피고의 공사비 및 사업관련비용은 원고들의 토지대금을 완불 후 피고가 인출할 수 있다.

㈏ 토지대금을 제외한 모든 분양대금(사업이익금 포함)은 피고의 수익으로 하며 부족금액 발생시 피고의 부담으로 한다.

6. 근저당 설정 및 이자부담 ㈎ 본 사업부지에 설정된 채권최고액 325,000,000원은 토지주인 원고들이 변제 의무가 있으며 원고들의 토지대금에서 상환하기로 한다.

㈏ 채권최고액 325,000,000원에 대한 이자지급은 공사착공시점 2010. 3. 31.부터 2010. 7. 31.까지(4개월)는 원고들이 부담하고 2010. 8. 1.부터는 피고가 부담하기로 한다.

7. The business rights shall cease to be run for at least 20 days and shall be smooth.
