피고인은 2018. 10. 9. 01:30경 부산 동구 B에 있는 C은행 앞길에서 D의 112신고를 받고 출동한 피해자 경위 E가 F 택시 안에서 술에 취해 자고 있던 피고인을 깨운 것에 화가 나, 위 택시에서 내린 뒤 D가 보고 있는 가운데 피해자에게 “개새끼야, 니가 뭔데 깨우냐, 어디 파출소에서 나왔냐, 이름을 보자.”, “씨발 내가 뭘 잘못했는데, 파출소 가자, 니 좆됐다, 씨발놈아 내가 누군줄 아냐.”라고 말하였다.
