The defendant's appeal is dismissed.

1. The summary of the grounds for appeal is unreasonable because the penalty (five million won of a fine) declared by the court below is too large.

2. The crime of this case, which infringes upon the right of a legitimate trademark right holder and disturbs the market economy order, is not against the defendant's liability in light of the crime period, sales amount, etc.

In addition, comprehensively considering the defendant's age, character and conduct, environment, family relationship, motive and consequence of the crime, etc., the sentence imposed by the court below is within the scope of the sentencing discretion assigned to the court below, and it cannot be deemed that the proper sentence is too unreasonable.

Therefore, the defendant's assertion of unfair sentencing is not accepted.

3. As such, the defendant's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act on the ground that it is without merit.
