[Defendant A] The defendant shall be punished by imprisonment with prison labor for ten months

However, the above sentence shall be executed for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

A In Pyeongtaek-si F, one gasoline storage place, 50,000 liter storage place, one light oil storage place, 40,000 liter storage place, 50,000 liter storage place, 50,000 liter storage place, and 12 alcoholic beverage storage place, and 'G gas station' is operated, and Defendant B and Defendant C are employees in the above gas station.

A From May 2015, while supplying oil to H (hereinafter “H”), around November 2016, when H had not received approximately KRW 350,000 million of the oil price from H, H entered the court management and subsequently H would be able to create and supply fake petroleum by mixing the oil with the oil in the future. Defendant A was in charge of the manufacture and sale of the fake petroleum upon receiving the order of oil, and Defendant B and Defendant C conspired to manufacture and sell the fake petroleum by sharing the role of selling it using the mobile tank storage (one name “house”; hereinafter “vehicle”) after manufacturing the fake petroleum.

1. Joint crimes committed by the Defendants

(a) No person shall manufacture, import, store, transport, keep or sell fake petroleum products for the purpose of using or making another person use them as fuel for a motor vehicle;

Nevertheless, on January 4, 2017, Defendant A instructed Defendant B and C, an employee of the G gas station, to manufacture fake petroleum. Defendant B and Defendant C manufactured a fake petroleum product after mixing it with the ratio of 4:6 through 5:5 by injecting it, and selling it to H by selling it, from January 4, 2017 to March 9, 2017, the sum of 45,80,742,32,32,614 liters, as indicated in the list of crimes in the attached Table, were manufactured and sold to H.

Accordingly, the Defendants conspired to manufacture fake petroleum products.
