A principal lawsuit and a counterclaim shall be deemed simultaneously.
Basic Facts
A. The Plaintiff is an executor of the sale of Ktel and sales facilities (hereinafter “instant building”) in Ulsan-gu JJ, Ulsan-gu. The Defendants are the buyers who purchased one of the instant buildings’ officetels and sales facilities from the Plaintiff.
B. The Defendants: (a) concluded a real estate supply contract with the Plaintiff on officetels or sales facilities among the instant buildings; or (b) succeeded to and acquired the right as a buyer from the buyer who was initially concluded with the Plaintiff.
(hereinafter “instant sales contract”). On June 10, 2016, Defendant B and Defendant C concluded a resale contract with the Plaintiff on June 10, 2018 with regard to the instant sales facility L sales facility No. 1 of this case, which entered into a sales contract with the Plaintiff on June 10, 2016, with regard to the sales facility No. 1 of this case on June 10, 2018.
