1. The Plaintiff:

A. Defendant B’s KRW 48 million and as to this, 5% per annum from October 29, 2016 to December 19, 2017.

1. Basic facts

A. Defendant B is a person who resells the Plaintiff the right to sell an officetel F on the ground of four parcels outside Seo-gu, a mining area (hereinafter “instant officetel F”), and the Plaintiff is the buyer.

B. Defendant C is a licensed real estate agent operating G Licensed Real Estate Agents located in the Gwangju Mine-gu, who arranged the resale contract between the Plaintiff and the Defendant with respect to the instant officetel H (hereinafter “instant officetel H”) and the sales contract between the Plaintiff and I Co., Ltd. (hereinafter “Nonindicted Company”).

C. On March 2, 2015, the Plaintiff entered into a resale agreement with Defendant B, at the sales office of the non-party company’s sales office, on the sales price of the instant officetelF at KRW 48 million (hereinafter “instant resale agreement”), and paid KRW 48 million to Defendant B, and paid KRW 50,000,000 to Defendant C as brokerage commission.

On March 3, 2015, the Plaintiff concluded a sales contract with the non-party company for the sales price of KRW 48 million (hereinafter “instant sales contract”) with the non-party company’s sales right of the instant officetel H, which is KRW 68,544,00,00, and paid KRW 48 million to the Defendant C on the day.

E. On March 23, 2012, Nonparty Company entered into a trust agreement with K Co., Ltd. (hereinafter collectively referred to as “K Co., Ltd.”) on sales management, while running the business of selling an officetel built on the land of the Seo-gu, Seo-gu, Gwangju and four parcels of land.

(hereinafter “the instant trust agreement”). The main content is that a trust company manages the ownership of an officetel business site, and if an officetel is newly constructed and registered as a preservation, the officetel ownership is also managed by the trust company, and only the trust company has the authority to sell the officetel and the sales price is also established by the trust company.
