The defendant shall be innocent.
Reasons
Public Prosecutor's Office
1. On May 2012, the Defendant forged a public document with a “C” number printed in advance on the “B” number indicated in the Defendant’s resident registration certificate at a non-permanent place, and copied it.
Accordingly, the defendant has forged one copy of the resident registration certificate under the name of the head of Gangseo-gu Seoul Metropolitan Government for the purpose of exercising.
2. On May 25, 2012, the Defendant: (a) drafted a letter at the Gangnam-gu Seoul Metropolitan Government D Building and the office of the office of the office of the office of the office of the office of the office of the board of dispute resolution in the fourth floor; (b) delivered a copy of the resident registration certificate, which is a forged public document, as described in paragraph (1), to F, who is an employee of the office of the office of dispute resolution
3. The Defendant: (a) had a cash of KRW 100,000 received under the pretext of delivering to G by the Plaintiff-E; and (b) had an intent to alter the certificate of a request for the transfer of money remitted to G.
around May 30, 2012, the Defendant sent KRW 25 million to G around June 30, 201 at the Gangnam-gu Seoul building and the Seoul Special Committee for the Settlement of Disputes in the fourth floor to G, and made a copy of the name of H as stated in the client column of confirmation of request for transfer and the client column that H transferred KRW 30 million to G around July 4, 201, and H transferred KRW 15 million to G around July 5, 201.
Accordingly, for the purpose of exercising, the defendant altered the certificate of request for confirmation of transfer to another person under the name of the president of I, which is a document related to rights and duties or proof of facts.
4. The Defendant at the time, at the same time and place as paragraph 3, delivered to F a certificate of confirmation of the request for transfer of each other altered in the manner described in paragraph 3 to F and exercised it.
