1. Demanding revocation of the registration of the persons of distinguished services to the national independence and their bereaved families against the defendant President;
Reasons
1. Details of the disposition;
A. The Plaintiff’s father B (hereinafter “the deceased”) was awarded the National Foundation Medal as the person of distinguished services to the national independence on August 15, 1982.
B. On November 19, 2010, the Defendant Minister of Patriots and Veterans Affairs requested the Minister of the Interior and Safety to submit a proposal on the revocation of a decoration on the ground that “the deceased’s friendship is confirmed and thus the deceased’s friendship is confirmed,” under Article 8(1)1 of the Awards and Decorations Act (amended by Act No. 10985, Aug. 4, 2011; hereinafter the same shall apply).
C. The Minister of Public Administration and Security presented the agenda to the State Council for the revocation of decoration, and the agenda was resolved by the State Council on April 5, 201, and the Defendant President sent electronically to the documents on the revocation of decoration to the Deceased on April 6, 2011.
On April 6, 2011, the Minister of Public Administration and Security notified the Defendant’s Minister of Patriots and Veterans of the determination of cancellation of a decoration, “The Minister of Public Administration and Security notified the State Council’s resolution and the President’s re-making that a person subject to the revocation of a decoration was confirmed as if he were attached to the decoration.”
E. On April 19, 201, Defendant Minister of Patriots and Veterans notified the Plaintiff of the revocation of decoration of the deceased for the persons of distinguished services to the national independence (hereinafter “Revocation of decoration of this case”) on the ground that “The deceased’s independence movement is recognized, but it is necessary to revoke decoration in full view of the participation of the Japanese institution and the pro-Japanese activities to support the war of aggression” (hereinafter “instant decoration revocation”).
