1. 업무 방해 피고인은 2016. 3. 26. 16:50 경 충남 태안군 C에 있는 피해자 D이 운영하는 ‘E’ 식당에서 술과 음식을 시켜 먹은 뒤 만취하여 아무런 이유 없이 피해자에게 " 이 씨 발 놈들 웃고 있어 “라고 욕설을 하고, 옆 테이블에서 밥을 먹고 있는 성명을 알 수 없는 손님들에게 ” 씨 발 놈들 뭘 쳐다봐 개새끼들 아 "라고 욕설을 하였다.

이어 피고인은 피해 자로부터 욕설을 하지 말고 그만 돌아가라는 취지의 말을 듣게 되자 격분하여 그 무렵부터 같은 날 19:23 경까지 피해자에게 계속하여 욕설을 하고, 위 식당으로 들어오려는 손님들에게도 “ 뭘 봐 병신새끼들 아 "라고 욕설을 하는 등 소란을 피워 위 식당에 있던 손님들이 겁을 먹고 나가게 하고, 위 식당으로 들어오려는 손님들이 들어오지 못하게 하였다.

2. 모욕 피고인은 2016. 3. 26. 19:55 경 제 1 항 기재 장소에서 112 신고를 받고 출동한 서산 경찰서 F 지구대 소속 피해자 순경 G으로부터 인적 사항을 묻는 질문을 받자 위 E 업주 D, 다수의 손님들이 있는 가운데 피해자에게 " 넌 뭐야 병신새끼야, 이 짭새 좆같은 새끼, 죽여 버린다 개새끼야", " 꺼져 짭새 새끼야 죽여 버리기 전에, 병신들 짭새 냄새 난다 개새끼야 "라고 큰소리로 욕설을 하여 공연히 피해자를 모욕하였다.

3.
