1. The defendant A shall be punished by imprisonment for one year;
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Defendant A, a person who was posted in an election of the NF head on March 11, 2015 and was killed, was willing to offer money and valuables to NF members or their family members for the purpose of election in an election.
No one shall offer, declare an intention to offer, or promise to offer money, goods, entertainment, other property benefits, or public or private positions to any elector (including a person who intends to become a candidate), his/her spouse, or an institution, organization, or facility to which a candidate belongs (including a person who is entitled to be entered in the electoral register before preparing the electoral register), his/her family member, or any person, organization, or public or private office, for the purpose of an election campaign, and shall make contributions during the period subject to restriction on contributions (from September 21, 2014).
Nevertheless, on November 2014, the Defendant offered 50,000 won in cash to P for the purpose of obtaining support from the N's election at the office of P located in Jung-gu Incheon, Jung-gu, Incheon, for the purpose of obtaining support from the N's election at the N's office, and provided 50,000 won in cash from that time to February 2015, as shown in the attached list of crimes, to union members or 31 family members as shown in the attached list of crimes, and made a contribution during the period of restriction.
2. An elector (including a person eligible to enter in the electoral register before preparing the electoral register) or any institution, organization, or facility established and operated by the elector or his/her family members, or the elector or his/her family members, shall not offer, manifest an intention to offer, or promise to offer money, goods, entertainment, other economic benefits, or public or private positions, and no person shall receive, or promise to offer, such benefit or position, and no person shall accept such offer;
