A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant is a person who sells oil from April 22, 201 to the trade name “D” in Incheon Dong-gu, Incheon.

No one shall manufacture, import, store, transport, keep or sell fake petroleum products.

1. On May 23, 2014, the Defendant, around May 23, 2014, manufactured fake petroleum products by mixing 60% with other petroleum products, such as light oil and oil, at the D places of business located in the Dong-gu Incheon Metropolitan City, Incheon, for sale, and continued to store 750-liters of fake petroleum products manufactured as above at the construction site of Gangseo-gu Seoul, Gangseo-gu, Seoul, and at the F mobile-type vehicle transit tank.

2. On June 17, 2014, around June 17, 2014, the Defendant continuously manufactured fake petroleum products by mixing them with 65% of other petroleum products, such as light oil, oil, etc., at the D places of business as indicated in paragraph (1) of the facts charged, and continuously stored 400-liters of fake petroleum products manufactured as above in E at the construction site as indicated in paragraph (1) of the facts charged, and in F mobile-type vehicle transit tanks, for the purpose of selling them.

3. On July 17, 2014, the Defendant, around July 17, 2014, manufactured fake petroleum products containing 3% or 70% of other petroleum products, such as light oil and oil, in order to sell at the D places of business as indicated in the facts charged, and continuously stored 470-liters of fake petroleum products, such as fake petroleum products, which combine 3% or 70% of other petroleum products, such as light oil and oil, into the construction site indicated in the facts charged, and a G mobile-type vehicle diesel tank, and stored 100-liters of fake petroleum products (1,600 won per liter) with 160,000-liters of fake petroleum products (1,600 won per liter) on a bit, and as above, stored 470-liters of fake petroleum products, such as fake petroleum products.
