A defendant shall be punished by imprisonment for not less than two years and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant is a blood relative with the victim C, and the victim is a mentally disabled person of the third degree.

1. From March 28, 2013 to around 15:00 on the same day, the Defendant committed an indecent act by inciting the victim’s chest and sound with his/her hand after getting off the victim’s clothes, cutting off the victim’s clothes, and cutting off the victim’s chest and sound with his/her hands, from a small place of residence of the D victim C (Inn, 20 years of age) of Gyeong-dong-gun, Gyeongnam-gun, Gyeongnam-do, and 17:0 on the same day.

Accordingly, the defendant committed an indecent act by force on the victim with mental disability.

2. Violation of the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes;

가. 피고인은 2013. 3. 29. 10:00경 제1항과 같은 장소에서 피해자 C(여, 20세)이 누워 있는 것을 보고 욕정을 품고 피해자에게 다가가 피해자를 안으며 상체를 일으켜 세워 다리와 배를 만지고, 이에 피해자가 “아이 간지러”라고 말하면서 몸을 뒤틀자 양팔로 피해자를 안아서 바로 눕혀 피해자의 위에 올라가 움직이지 못하게 한 후, 손으로 피해자의 상의를 올려 벗기고 피해자의 하의와 팬티를 벗긴 후 입으로 가슴과 음부를 빤 다음, 손가락을 피해자 음부에 넣었다가 발기된 자신의 성기에 미리 준비한 콘돔을 씌워 피해자의 음부에 삽입하여 간음하려고 하였으나 피해자가 아프다고 하여 제대로 삽입하지 못하고 사정을 하였다.

Accordingly, the defendant tried to have sexual intercourse with the victim with mental disability by force, but he attempted to have such sexual intercourse.

B. At around 11:00 on April 1, 2013, the Defendant: (a) reported the part of the body between the victim’s legs, which is rhythming television, such as the victim C, at the inside of the same residence as the above paragraph (a).
