1. The plaintiff's claims against the defendants are all dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. The relation 1) The Plaintiff is the Plaintiff’s new construction of multi-household housing with 12 households above the 8 parcels of Goyang-gu, Seoyang-gu, Yangyang-si (hereinafter “instant multi-household housing”), and the said new construction work is “the instant construction work”.
(2) Defendant A is a company that contracted the instant construction to the Plaintiff, and Defendant Asia Trust Co., Ltd. (hereinafter “Defendant trust company”) is a company that completed the registration of ownership transfer based on trust with respect to 11 households among the instant housing.
B. On June 21, 2013, C Co., Ltd., Ltd. (hereinafter “C-Ik Construction”), Inc., Ltd., Ltd. (hereinafter “C-Ik Construction”).
(A) The construction of the instant case was contracted and the content relevant to the instant case in the said contract are as follows. The standard contract for private construction works (Evidence A 4)
1. Construction name: Multi-household housing construction works (12 households) in ancient cities;
2. Place for construction: The area of the construction project: The area of the land between Gyeyang-gu and 8 parcels;
5. Contract amount: The contract amount shall be 1.8 billion won per day (excluding value-added tax), and the price shall be 43 square meters for each household and 400 million won in cash.
7. Advance payment: To pay 50 million won in cash within five days after the commencement of the relevant project.
8. Endd amount: The first Initial - the second Initial 10 million Won 50 million Won - the third Initial 100 million Won - the fourth 4 initial 100 million Won - the process 80 per cent after the completion of 60 per cent (within 7 days) - the general conditions of the standard contract for private construction works of KRW 100 million (within 7 days) and other matters not specified in this contract, prior to any special agreement determined by the agreement between "A (referring to "the contractor")" and "B (referring to "contractor")".
(3) The amount of four households (area subject to permission) which a contractor pays to the contractor as the price for the work shall be determined as the total of four households, 1, 2, 5, and 2, and the orderer shall complete the preservation registration after completion.
