Where the defendant fails to pay the above fine, one million won shall be the one day.

Punishment of the crime

From March 1, 2013 to August 31, 2014, the Defendant served as a professor of the landscaped course of the Korea Agricultural University from D University from around July 1, 1998, to around August 31, 2014, as the vice president of the Industry-Academic Cooperation Foundation affiliated with the Victim D University (hereinafter “victim Industry-Academic Cooperation Foundation”), and from around September 1, 2014 to around November 11, 2014, the Defendant served as the vice president of the Victim Industry-Academic Cooperation Foundation affiliated with the Victim.

The Defendant, as a person in charge of research and development tasks according to a total of seven national research and development projects, including “F” research and development tasks supported by the E Foundation from March 2010 to April 2014, has been supported by a total of KRW 389,00,000,000.

Meanwhile, according to the "Regulations on the Management, etc. of National Research and Development Projects" and "Regulations on Research Expenses of D University", a victim industry-academic cooperation foundation shall receive research services from each ordering agency, such as government departments, and enter into related contracts, manage business funds by collecting them, and execute the project funds in accordance with a request for payment of research expenses, along with evidential documents. ① If a researcher participating in a research and development task is employed by a separate institution, etc. and receives personnel expenses from the relevant institution, etc., he/she shall specify whether the part of the personnel expenses incurred in the research task of the relevant research institute is employed in kind or unpaid personnel expenses, and shall not be paid separately. ② At the request of the research officer, the victim industry-academic cooperation foundation shall collect and manage the personnel expenses directly transferred from the victim industry-academic cooperation foundation to the personal account of the student researcher, and if so, he/she shall return the full amount of the personnel expenses jointly managed.

Therefore, even if the victim industry-academic cooperation foundation applies for personnel expenses for the student researchers who participate in the actual research, the researcher is the researcher.
