A defendant shall be punished by imprisonment for four months.

An application filed by an applicant for compensation shall be dismissed.

Punishment of the crime

On October 15, 2014, the Defendant was sentenced to two years of imprisonment with prison labor at the Gwangju District Court for fraud, etc., and the judgment became final and conclusive on December 11, 2014.

1. On May 24, 2013, the fraud Defendant received a mobile phone device from a “D” office operated by the Defendant on the Gyeyang-gu, Gyeyang-gu, Incheon, Incheon, and the first floor, to an employee with no knowledge of the name of the victim’s est liaison company, and made a false statement as if he would pay the price.

However, the defendant did not have the intention or ability to pay the price even after receiving the mobile phone from the victim.

Nevertheless, the Defendant, by deceiving the victim as above, received one mobile phone terminal (a model name: SHV-220S) and one core chip from the victim at the market price of 6.80,000 won.

In addition, from that time until June 12, 2013, the Defendant deceivings the victim by the same method and received from the victim a total of 4,4360,500 won of the market price and 70 core chips, such as the list of crimes in the attached Table (1).

2. No person who violates the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc. shall knowingly receive any personal information for profit or any unlawful purpose;

Nevertheless, around May 24, 2013, the Defendant received the personal information from a person who was aware of the name that he/she sold the personal information acquired through an Internet search to open a mobile phone by stealing another person’s name at a place specified in paragraph (1) with an intent to open a mobile phone, with the knowledge of the fact that the personal information was divulged by receiving a copy of an identification card of the subject of information E from a person who was unable to know that he/she was divulged

In addition, from that time until June 12, 2013, the personal information of the subject of information is the personal information of 27 subjects, such as the list of crimes in attached Form (2).
