A and Defendant B shall be punished by imprisonment for 8 months, by imprisonment for 4 months, by a fine of 50,000 won, and by imprisonment for Defendant D.

Punishment of the crime

Defendant

A is the head of the site of the new construction of the H sales facility in the Changwon-si, Changwon-si, Masan-si, who is a person in charge of overall control over the field supervision and safety management of the construction site. Defendant B is the joint manager of the FF corporation, and Defendant C and D are the joint manager of the F corporation, and Defendant E is the joint manager of the F corporation. Defendant E is a corporation established for the construction work, etc., and the construction cost of the said new construction is KRW 930 million, and Defendant F corporation is a corporation established for the purpose of manufacturing the steel structure, etc., and is subcontracted in the amount of KRW 30 million from E corporation.

1. Defendants A and B’s joint criminal conduct (the occupational death and violation of the Occupational Safety and Health Act) had the victim J, who is an employee of FF Co., Ltd., work for the installation of a steel frame at the construction site around November 15, 2018. At the time, the steel frame construction site was located at approximately 13 meters in height, and the worker was at the risk of fall.

In such cases, a business owner shall install a work plate by assembling a gauge in order to prevent the fall risk of workers in the work, and where it is impracticable to install a work plate, a safety control net shall be installed, and where workers wear a safety belt at a place of at least 2 meters high, a safety belt shall be installed.

Nevertheless, the Defendants were negligent in failing to install a work plate or a safety watch, and without installing a facility that enables workers to walk the safety belt.
