Punishment of the crime
Defendant
A is a person who operates H companies engaged in the construction of plastic houses, the sales of agricultural materials, etc. in Jinju-si, and Defendant C is a person who is engaged in agriculture as an auditor of the J Agricultural Cooperative established in Jinsung-gun I for the purpose of agricultural production, etc., and Defendant B is a person who is engaged in agriculture.
1. Defendant A and B provided funds to Defendant B so that Defendant B would be entitled to a subsidy as a subsidized project operator in the project for the creation of the Ulsan-Mastoma Production Complex in 2012 (hereinafter referred to as “the project for the creation of a local characteristics of the High Military Department in 2012”). On June 2012, Defendant B provided funds to Defendant B so that Defendant B would be able to make a disguised payment as if the said subsidized project was actually paid, while executing the said subsidized project. Defendant B provided false evidential documents by means of remitting the funds received from Defendant A as if the said expenses were to have been paid by himself/herself, and then recruited Defendant B to receive subsidies from the victim by means of using them.
The project for the creation of the Ulsan metropolitan production complex, which is implemented by the injured Gyeongnam-gun, to improve the competitiveness of the facilities through the modernization of the underdeveloped facilities, and to increase the farmers' income through the stabilization of the vegetable production, the injured party provided 70% of the facility project cost (35% of the military costs and 35% of the national costs) to the relevant farmers on the condition that the farmers selected as the subsidized project operator bear 33,278,000 won, the total project cost of the subsidized project related to the defendant B shall be 103,278,000 won, and the subsidy shall be 230,000,000 won (71,000 won after the settlement of the next year).
