A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

피고인은 2019. 8. 14. 01:00경 서울 중랑구 B, C에 있는 피고인의 주거지에서 채팅 어플리케이션 '즐톡'을 통해 알게 된 피해자 D(가명, 여, 36세)과 라인(LINE) 메신저를 이용하여 대화를 나누던 중 피해자에게 ‘사진을 보내달라’고 요구하여 피해자로부터 자신의 얼굴, 가슴, 음부를 스스로 촬영한 사진을 전송받은 후 2019. 8. 14. 22:30경 피해자를 만나기로 약속하였으나, 피해자가 만남을 회피하자 피해자에게 앙심을 품게 되었다.

On August 14, 2019, the Defendant attempted to go to the public, at around 23:30 on August 14, 2019, informed the victim of the Defendant’s residence of his account number (E) in the name of the Defendant, and then, informed the victim of his/her defense of the account number (E) in the name of the Defendant. In doing so, the Defendant threatened the victim of his/her intention to spread his/her photograph by creating a leaflet without sending money.

The Defendant, as seen above, attempted to bring money from the victim, but did not reach the intent of the victim because the victim did not respond to it.

2. 특정범죄가중처벌등에관한법률위반(보복협박등) 피고인은 2019. 8. 15. 01:40경 서울 중랑구 F에 있는 G(동부지점) 앞에서 피해자를 만나기로 약속하고 나갔으나, 피해자가 피고인으로부터 협박받은 피해사실에 대해 경찰서에 신고하여 경찰관과 함께 위 약속장소에 온 것을 발견하고, 자신의 휴대폰을 이용하여 피해자에게 '경찰 짜바리 데리고 오셨네, 와 그 사이 경찰 신고하느라 시간 끈거냐 존나 어이없네, 멀리서 보니깐 형사 존나 깔아뒀더라'라는 등 경찰에 신고한 것에 대해 불만을 표시하는 내용의 메시지를 수회 보내고, '경찰관을 돌려보내지 않으면 피해자의 얼굴, 가슴, 음부 사진을...
