The prosecution against the defendant is dismissed.

1. On May 20, 2013, at around 00:05, the Defendant, at the time of assaulting C, which is a cause of service in front of the Jongno-gu Seoul Jongno-gu Seoul Office, and was dispatched to the police officer affiliated with D (39 years of age) who was asked about the factual basis to the above C and the unspecified number of persons being considered to have been asked about the factual basis, the Defendant expressed the victim’s publicly insulting speech with the larger sound, “this spacks, spacks, spacks, and sprinks.”

2. The above facts charged are crimes falling under Article 311 of the Criminal Act, which can be prosecuted only when the victim files a complaint under Article 312(1) of the Criminal Act. According to the records, the complainant D, after the prosecution of this case, cancelled the complaint against the defendant on July 3, 2013. Thus, the prosecution against the defendant is dismissed in accordance with Article 327(5) of the Criminal Procedure Act.
