Reasons
Punishment of the crime
The defendant is a person who operates a communications sales business under the trade name of "C" in Yeongdeungpo-gu Seoul Metropolitan Government.
No one shall indicate or advertise that the nutritional value, raw materials, ingredients, or uses of foods or additives have efficacy or effect in preventing and treating diseases, or that such labeling or advertisement may cause mistake or confusion as medicine or health functional foods.
Nevertheless, between August 31, 2016 and around August 31, 2016, the Defendant sold ‘welling household’ products on the Internet homepage (D) operated by the Defendant, and indicated and advertised the effect of the product as to the effect of the product, such as the promotion of immunity, resistant effect, reduction of physical area, reduction of salt/hyr cancer, prevention of urine and urine diseases, functionality published through a research paper on the effects of the product, such as “the use of so-called” as to the effect of the product, advertisement of the product, which is likely to have efficacy and effect in the prevention and treatment of diseases, or to mislead or confuse it as medicine or health functional food.
