A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for three years from the date of the final judgment.

Punishment of the crime

The Defendant is the Chairperson of the Incorporated Association (hereinafter referred to as the “C Association”) established for the purpose of education, employment, and rehabilitation self-support of persons with disabilities in the territory of the Armed Forces, and is a person in charge of the management of funds, budget application, event planning, employment and management of employees, etc. while actually operating the said Association.

The Defendant: (a) opened an account under the name of C Association and its place of business, such as a welfare center entrusted by C Association and its place of business; (b) received employment subsidies from C Association and the Korea Employment Agency for Disabled Persons; (c) opened an account under the name of D, E, F, G, and H that they had been working at the said Association or its place of business; and (d) embezzled them by means of cash transfer as payment; and (d) embezzled them by means of cash transfer as if the said Association did not have participated in the Seoul International Wheeltonship without having participated in the Seoul International Wheeltonship.

1. From July 29, 2004 to July 31, 2012, the Defendant: (a) transferred 600,000 won to the Agricultural Cooperative account in the name of D having no employee working in the said Association while receiving subsidies from the C Association office in the name of the victim C Association; and (b) transferred 600,000 won to the Agricultural Cooperative account in the name of D having no employee working in the said Association; and (c) immediately withdrawn it in cash and arbitrarily consumed it for living expenses, etc. around that time; and (d) as described in the attached List of Crimes (1) from July 29, 2004 to July 31, 2012, the Defendant remitted 151,171,236 won in total to each of the accounts in the name of D, E, F, G, and H, which had not been working in the said Association while working for the victim.
