For the reasons indicated in its holding, the lower court rejected the Defendant’s allegation of the grounds of appeal as to the misapprehension of the legal doctrine of the prosecutor, on the grounds that the first deliberation judgment was justifiable, that it is difficult to view the Defendant’s instant remarks as an insulting speech.

Examining the reasoning in light of the relevant legal principles and records revealed by the first instance court, the lower court did not err in its judgment by misapprehending the legal principles on insult, contrary to what is alleged in the grounds of appeal.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
