Defendant shall be punished by a fine of KRW 2,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

Part of the facts charged in the indictment was revised according to the facts obtained through the examination of evidence without the amendment process to indictment to the extent that it does not disadvantage the defendant's defense right.

1. 절도 피고인은 2019. 2. 1. 02:40경 서울 광진구 B건물, 2층에 있는 ‘C주점’에서, 피해자 D이 자리를 비운 틈을 이용하여 14번 테이블 위에 있던 피해자 소유인 현금 10만 원, SC체크카드, 기업은행 체크카드, 카카오뱅크 체크카드, 코나카드 및 주민등록증 각 1장이 든 지갑 1개, 시가 20만 원 상당의 에어팟 1개, 시가 25만 원 상당의 반지 1개가 든 시가 20만 원 상당의 아키클래식 롱패딩 1개를 몰래 가지고 갔다.

Accordingly, the defendant stolen the victim's property.

2. On February 1, 2019, at around 02:51, the Defendant settled KRW 9,000 for the purchase price by purchasing tobacco 2 A, and presenting to its employees the SCR card that was stolen as if the Defendant was the Defendant’s card.

From February 5, 2019 to February 17:30, the Defendant acquired a total of 31,400 won, including the attached list 1, in the same manner in Seoul Special Metropolitan City, Gwangjin-gu and Nowon-gu.

3. On February 1, 2019, the Defendant attempted to purchase tobacco at the same place as above 02:51 on February 1, 2019 at the same time as above 02:51, and to pay KRW 9,000 of the price by presenting the stolen SCR card to his/her employees as if he/she was the Defendant’s card. However, the Defendant failed to pay due to the shortage of balance.

The defendant, from February 5, 2019 to February 17:54, 2019, tried to settle a total of KRW 28,980 in the same manner in Seoul Special Metropolitan City, Gwangjin-gu and Nowon-gu, as shown in attached Table 2, on a total of six occasions, but it is not due to the shortage of balance.
