The defendant shall be innocent.

1. On June 15, 2017, the Defendant: (a) driven a CC motor vehicle around 11:30, and was straighted along the three-lanes of the Taedong-gu Daejeon High University; (b) one-lanes in the direction of the head of the Han-gu National University from the direction of the Han-gu National University.

Since a signal, etc. is a three-distance intersection where the signal, etc. is installed and operated, a person engaged in driving service has a duty of care to reduce the speed and to prevent accidents by safely driving the signal in accordance with the signals in advance.

Nevertheless, the Defendant neglected this and allowed the victim D(76) who was driving E-si to turn to the left at one-lane road in the direction of the Hannam University from the direction of the Hannam University due to sudden negligence after entering the intersection in violation of the red signal, which is prohibited to proceed in the front part of the Defendant’s vehicle.

Ultimately, the Defendant suffered an injury to the left-hand shoulder and the string of the horse that requires treatment for up to seven days due to the above occupational negligence.

2. The defendant and defense counsel;

A. The Defendant only entered the intersection through a straight line and does not violate the signal.

B. “The left-hand shoulder and the stude of a satisfy that requires treatment for a period of seven days generated by the victim” is naturally able to be treated without need for treatment, and does not constitute “injury.”

3. Determination

A. According to the evidence duly adopted and examined by this court, such as the witness witness D’s legal statement, the actual condition of traffic accidents, and the signal cycle table, the defendant met the front part of the defendant’s vehicle as a taxi driving by the victim, who entered the intersection as it was a red signal prohibited from proceeding at the time of the accident of this case, and immediately left-hand turn at the intersection after entering the intersection.
