Defendant shall be punished by a fine of KRW 1,500,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

1. Violation of fishing villages or fishery harbors;

(a) Any person who intends to use or occupy fishery harbor facilities occupying and using such fishery harbor facilities without permission shall obtain permission from the fishery harbor management authority;

그럼에도 불구하고 피고인은 2015. 8. 29. 경부터 2016. 8. 17. 경까지 화성시 C에 있는 D 어항구역 내에서 어항 관리 청의 허가를 받지 아니하고 컨테이너 1 동 및 천막을 설치하여 두고 핫도그, 오뎅, 떡볶이, 라면 등을 판매하는 휴게 음식점 영업을 하여 허가를 받지 아니하고 어항시설을 점용하였다

B. On June 21, 2016, the Defendant failed to comply with an order to reinstate the land in the name of the Chinese market, even though he/she was issued a written order to reinstate the land in the name of the Chinese market by June 30, 2016, with respect to the possession of the fishery harbor zone without permission, as set forth in paragraph 1(a), from an irregular viewing employee in the D fishery harbor zone located in Dasung-si, G, by operating the container coordinate as set forth in paragraph 1(a).

2. 식품 위생법위반 피고인은 제 1의 가항 기재 일시ㆍ장소에서 관할 관청에 영업신고를 하지 아니하고 컨테이너와 천막을 이용하여 그 곳을 찾은 불특정 다수의 사람들을 상대로 핫도그, 오뎅, 떡볶이, 라면 등을 조리하여 판매함으로써 무신고 휴게 음식점 영업을 하였다.
