A defendant shall be punished by imprisonment for a term of one year and two months.
Reasons
Punishment of the crime
1. Around November 25, 2009, the criminal defendant against the victim C expressed that “A victim of E-Saba, operated by the victim C of E-Saba in Young-gu, Suwon-gu, Suwon-si, would engage in a wholesale wholesaler that receives the Jeju-do conflict by air and deliver it to the general restaurant, and would give a large amount of profit if he/she invests money. On January 201, 201, the criminal defendant called “the victim would purchase a double knife with the victim, and would give a profit by doing a business that actually sells the knife.”
However, the Defendant did not operate a wholesale wholesaler, and did not have any fact that he purchased a ship, and the Defendant did not have any intent or ability to repay money even if he did not have any property from the victim due to the lack of basic living beneficiaries.
The Defendant received total amount of KRW 90,520,000 from November 25, 2009 to March 26, 2010, as shown in the list of offenses (1) from the victim.
Accordingly, the defendant was given property by deceiving the victim.
2. The Defendant, around August 2012, against the victim F, told the victim F to the effect that “I would complete a short-term funeral if I want to purchase a dry field with a short-term care, and if I would lend money with a large amount of profit, I would like to complete a short-term funeral.”
However, the defendant did not purchase a sense of unity, and even if he borrowed money from the victim due to the lack of property from the basic livelihood recipient, the defendant did not have the intention or ability to pay the money.
The Defendant received a total of KRW 47,00,000 from August 6, 2012 to December 4, 2012 from the victim, as shown in the annexed crime list (2).
Accordingly, the defendant was given property by deceiving the victim.
