가. 피고인 A 피고 인은 위 C, 위 D과 공모하여, 2015. 2. 27. 경 P에게 ‘ 내가 다 알아서 할 테니 통장만 하나 만들어 달라’ 는 취지로 설명하여 보험 가입 승낙을 받음 다음, 마치 위 P이 피해자 ㈜Q에 정상적으로 가입하여 보험료를 납부할 것처럼 P에 대한 보험 가입 청약서를 작성하고 이를 피해자 보험사 담당 직원에게 제출하여 이에 속은 위 보험사 담당 직원으로부터 2015. 3. 25. 경 보험 모집 수당 명목으로 2,952,150원을 지급 받았다.

이를 비롯하여 피고 인은 위 C, 위 D과 공모하여, 2015. 3. 25. 경부터 2015. 10. 23. 경까지 위와 같은 방법으로 별첨 범죄 일람표 1-1 내지 1-3 기재와 같이 피해자 ㈜Q으로부터 36회에 걸쳐 합계 124,948,543원, 피해자 ㈜R으로부터 6회에 걸쳐 합계 19,629,787원, 피해자 ㈜S으로부터 4회에 걸쳐 합계 4,959,240원을 각각 보험 모집 수당으로 지급 받음으로써 총 46회에 걸쳐 합계 149,537,570원을 편취하였다.
