1. The defendant shall be the plaintiff.

A. Of the real estate 1st floor 225.16 square meters listed in the attached Table 1 list, the Attached Form 2 Map No. 1, 2, 3, 4, 5, 1 shall be marked.

1. The facts following the facts of recognition do not conflict between the parties, or may be acknowledged by adding to the whole purport of the pleadings the entries in Gap evidence 1 to 4, Eul evidence 1, 3, and 4 (including each number):

The real estate listed in the attached list 1 related to the ownership of real estate (hereinafter “instant building”) is jointly owned by the Plaintiff and the Plaintiff C and D.

B. (1) While Plaintiff F entered into a lease agreement with the Defendant, the Plaintiff, the inheritor, after F’s death, succeeded to the said lease agreement. On November 2008, the Plaintiff entered into a lease agreement with the Defendant and the first floor of the instant building by setting the lease deposit of KRW 10 million, monthly rent of KRW 80 million, November 13, 2008, and November 12, 2010 from November 2008. The Defendant paid the said lease deposit and received the said real estate.

(2) On December 3, 2010, the Plaintiff and the Defendant concluded a lease agreement with respect to subparagraph (E) on the first floor of the instant building by setting the lease deposit of KRW 15 million, monthly rent of KRW 800,000,000 from December 3, 2010 to December 2, 2012. On January 8, 2013, the Plaintiff and the first floor of the instant building concluded the lease agreement by setting the lease deposit of KRW 15 million with respect to subparagraph (E) from among the first floor of the instant building, and the lease agreement from January 8, 2013 to January 7, 2015.

(3) On April 26, 2014, the Plaintiff and the Defendant concluded a lease agreement with respect to the instant building 1st floor G real estate by setting the lease deposit of KRW 25 million, KRW 1.2 million per month, and the term of lease from April 30, 2014 to April 29, 2016.

(4) On April 29, 2016, the Plaintiff and the Defendant: (a) indicated the leased object as 23.1 square meters in the (A) section of 35.3 square meters lease contract, which successively connects each point of the attached drawing Nos. 1, 2, 3, 4, 5, and 1 among the 225.16 square meters of the instant building 1st floor; (b) however, as determined thereafter, the Plaintiff and the Defendant entered into a lease contract with respect to 35.3 square meters of land as determined thereafter, and thus indicated as such.
