1.With respect to the Plaintiff, Defendant B shall be subject to the land listed in Schedule 1.1, and the Defendant’s Republic of Korea shall be the same list.
Reasons
1. Basic facts
A. The Plaintiff is the heir of the network E, who is the original owner of each land listed in the separate sheet (hereinafter “instant land”) prior to the division of each land listed in the separate sheet, and the change of administrative districts, “D 1,501 square meters prior to the Jeju-do North Jeju-gun (hereinafter “instant land prior to the division”).
B. The instant land prior to subdivision was purchased from the Republic of Korea on June 21, 1949 and the ownership transfer registration of the Defendant was completed on January 12, 2009 following the enforcement of the former Farmland Reform Act (amended by Act No. 31, Jun. 21, 194; Act No. 4817, Dec. 22, 1994; hereinafter “farmland Reform Act”) as the farmland was repealed from January 1, 1996. Since the subdivision, the ownership transfer registration was made under the name of the Defendant B on January 12, 2009.
C. Before subdivision, the instant land was divided into KRW 1,493 on October 25, 1967 and KRW 8 on G, and the said G land was converted into a road on December 7, 1967, and the area was converted into a flat distance on May 1, 197, and the area was converted into a flat distance. On May 1, 197, the North Jeju Jeju-gun H was converted into the Jeju-do Jeju Special Self-Governing Province on July 1, 2006.
Defendant Republic of Korea completed the registration of ownership transfer on the land of this case before subdivision under the Jeju District Court No. 2033 on March 2, 1972 on the ground of "trade on June 21, 1949, the enforcement date of the Farmland Reform Act," and Defendant B completed the registration of ownership transfer as the Jeju District Court No. 1818 on December 29, 2008 on the land specified in attached Table 1. Paragraph 1 after subdivision.
E. According to the entry of the former Land Register as to the land of this case before subdivision, the registration of ownership transfer has been completed on July 31, 1930, which had an address in I on July 31, 1930, and the former land cadastre also includes E having an address in J as the transfer of ownership on the same day.
F. The instant land before subdivision is made to the State in accordance with the Farmland Reform Act.
