A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment became final and conclusive.

Punishment of the crime

On August 25, 2014, the Defendant, at the site office for the construction of a site for electric source housing located in Dong-gu, Chungcheongnam-gu, Incheon Metropolitan City, to operate a business and distribute the proceeds therefrom, “the business of newly building and selling electric source housing on 9,256 square meters of the forest land located in Dong-gu, Chungcheongnam-gu, Incheon Metropolitan City among the forest land B located in Dong-gu, 2013.” The Defendant paid the balance of the forest land borrowed under the name of the Defendant and paid the remainder of the sale of the said forest land under the name of the Defendant, and the registration of preservation of ownership is to be made under each Defendant’s name as to

On July 9, 2015, according to the above business agreement, the Defendant completed the registration of ownership preservation in the name of the Defendant with respect to subparagraph D-based housing unit E after dividing the above forest into the forest and field around July 9, 2015.

On July 29, 2015, the Defendant acquired and embezzled total amount of KRW 1,287,570,570,000 by selling or donating to another person without consultation with the victim as shown in the list of crimes in the attached Table, such as selling to F 237,570,000 won and completing the registration of ownership transfer.
