1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

Reasons

(a) is a person;

나. 씨티웍스와 피고 사이의 이 사건 토지에 대한 매매계약의 체결 등 씨티웍스는 2005. 12. 12. 피고로부터 이 사건 토지를 대금 5,865,255,000원에 매수하기로 하는 아래와 같은 내용의 매매계약을 체결하고(이하 ‘이 사건 매매계약’이라고 한다), 피고에게 2005. 12. 12. 제1차 계약금 10,000,000원, 2006. 1. 23. 제2차 계약금 576,525,500원 합계 586,525,500원(이하 ‘이 사건 계약금’이라고 한다)을 지급하였다.

제1조(목적) 위 부동산의 매매에 대하여 매도인(피고를 가리킨다. 이하 같다)과 매수인(씨티웍스를 가리킨다. 이하 같다)은 합의에 의하여 매매대금을 아래와 같이 지불하기로 한다.

Article 5 (Termination of Contract) Before the buyer pays any balance to the seller, the buyer shall reimburse the amount of the contract and the buyer may waive the contract deposit and terminate this contract at the time of the buyer's default.

Article 6 (Non-performance of Obligations and Compensation for Damages) If the seller or buyer has defaulted on the terms and conditions of this Agreement, the other party shall be the person who has defaulted.
