Reasons
Basic Facts
Defendant A is registered as the owner of each real estate listed in the attached list Nos. 1 and 2, and Defendant B as the owner of each real estate listed in the attached list No. 3.
Defendant A and Defendant B are vice versa.
The network F is registered as the owner of the real estate listed in the attached list No. 4, and died on May 17, 2010, and the defendant D, C, and E inherited one third of the network F, respectively.
On February 2, 2013, the Plaintiff concluded a sales contract with Defendant A and B to purchase each real estate listed in the separate sheet of KRW 470,000,000 (hereinafter “instant sales contract”).
According to the instant sales contract, the buyer is indicated as “Plaintiff and one other”.
(A) The term “Plaintiff” is indicated as “one other than the canple of the Co., Ltd.,” and the Kavoon changed its trade name on November 30, 2012 to “the development of the Manae Investment Industry” as of November 30, 2012; hereinafter “Plaintiff” regardless of whether it was before or after the mutual change. The term deposit under the instant sales contract was set at KRW 25,000,000 for the remainder, and KRW 445,00,000 for the remainder. On February 15, 2013, the Plaintiff remitted the down payment of KRW 25,00,000 to the Defendant’s account.
The land listed in the attached list, which was the object of the instant sales contract, is included in the area where the G Regional Housing Association planned to implement the project, and the G Regional Housing Association intended to construct the housing on the said land after acquiring the ownership of each land listed in the attached list.
(tentative) The G Regional Housing Association Promotion Committee held the inaugural general meeting on April 22, 2013, and (tentatively named) the G Regional Housing Association Promotion Committee entered into an enforcement contract on May 9, 2013 with the Plaintiff to carry out the construction project of multi-family housing under the Housing Act.
The instant sales contract concluded by the Plaintiff with Defendant A and B is also concluded according to the agency contract concluded between the Plaintiff and the Promotion Committee of the Regional Housing Association (tentatively named).
The G Regional Housing Association shall be in accordance with the provisions of Article 32 of the Housing Act from the following market on September 17, 2012.
