A defendant shall be punished by imprisonment for two years.

The defendant shall pay 500,000 won to B who is an applicant for compensation.

Punishment of the crime

[Criminal Power] On January 23, 2019, the Defendant was sentenced to four months of imprisonment for fraud in the Suwon District Court’s Ansan Branch, and was released on May 22, 2019 as a decision to revoke detention during the enforcement of the sentence, and the execution of the sentence was terminated.

[200 large group 25] On November 1, 2019, the Defendant posted a false statement that “The sales of a new world merchandise coupon is sold” on E’s website in Ansan-gu Ctel D in Ansan-si, Annyang-si, Annyang-si, and falsely read that “the victim F, who reported the above writing to the Defendant and contacted the Defendant, will send a new world merchandise coupon if he remitted KRW 450,000 to the Defendant.”

However, in fact, the defendant did not have merchandise coupons, and was thought to use the money received from the victim for personal purposes, such as living expenses, and therefore, he did not have the intent or ability to sell the merchandise coupons as agreed to the victim.

As above, the Defendant, by deceiving the victim as above, received 450,000 won from the victim to the G bank account (number: H) under the name of the Defendant on the same day, and acquired 3,81,000 won in total from the above date to December 16, 2019, as shown in the annexed Crime List (1).

[207] Around November 2, 2019, the Defendant made a false statement to the victim I who became aware of the fact through E transactions, stating that “The Defendant will repay KRW 430,000 on the following day if he/she borrowed KRW 400,000 as a mobile phone text message.”

However, even if the defendant borrowed money from the victim, he did not have the intention or ability to repay it.

As above, the Defendant, by deceiving the victim as above, received 400,000 won from the victim’s J bank account (K) in the name of the Defendant on the same day, and received a total of seven times from around that time to November 17, 2019, including the amount of KRW 1,109,50,000 from around that time, as shown in the List of Crimes (2).
