After recognizing the facts in its reasoning based on the adopted evidence, the lower court determined that the amount transferred by the Plaintiff was a loan to the Defendant, i.e., a monetary loan, given to the Defendant, that is, a monetary loan contract.

In light of the relevant legal principles and records, the judgment of the court below is just, and there is no violation of the principle of pleading, or omission of judgment at the court below.

Therefore, the appeal is dismissed, and the costs of appeal are assessed against the losing party. It is so decided as per Disposition by the assent of all participating Justices.
